SUMMARY OF ORDINANCE NO. 588 An Ordinance Granting Centerpoint Energy Resources Corp., D/B/A Centerpoint Energy Minnesota Gas ("Centerpoint Energy"), Its Successors and Assigns, a Nonexclusive Franchise to Construct, Operate, Repair and Maintain a Gas Distribution System Including Necessary Gas Mains, Pipes and Equipment for the Transportation, Distribution and Sale of Gas for Public and Private Use and to Use Public Ways and Public Grounds of the City of Cambridge for Such Purposes; and Prescribing Certain Terms and Conditions Thereof. The following is the official summary of Ordinance No. 588 approved by the Cambridge City Council on June 17, 2013. The purposed of the ordinance is to grant to CenterPoint Energy a ten year, non-exclusive franchise to operate, repair and maintain a natural gas distribution system within the city limits of the City of Cambridge. A complete copy of this ordinance is on file at Cambridge City Hall, 300 3rd Avenue NE, Cambridge, MN 55008 for public inspection. The terms and conditions of service and the rates to be charged by CenterPoint Energy for natural gas energy are subject to the exclusive jurisdiction of the Minnesota Public Utilities Commission. The ordinance provides for a method of dispute resolution if either the City of Cambridge or CenterPoint Energy asserts that the other party has defaulted in the terms of the gas franchise ordinance. The ordinance provides that all gas facilities shall be located, constructed, and maintained so as not to interfere with the safety and convenience of ordinary travel along and over public ways. The ordinance also provides that CenterPoint Energy shall indemnify and hold the City of Cambridge harmless from liability on account of injury to persons or damage to property occasioned by the construction, maintenance, repair, inspection, the issuance of permits, or the operations of the Gas Facilities located in the City of Cambridge's public rights of way and public grounds. BREW PUB - An establishment in which malt liquor is brewed or manufactured for sale and consumption on tap at the premises where the malt liquor is brewed or for sale an personal consumption off the brewers premises. Chapter 76, Article IV, Section 76-14 Types of Licenses, of the Code of the City of Isanti is hereby amended to add the following licenses: K. Brew Pub Off-Sale Malt Liquor License. A brew pub off-sale malt liquor license may be issued, with the approval of the Commissioner of Public Safety, to a licensed brewer who brews less than 3,500 barrels of malt liquor in one year and holds an on-sale intoxicating liquor license issued by the City to a restaurant operated in the place of manufacture, subject to the following conditions: a.The malt liquor sold off sale must be produced and packaged on the licensed premises in authorized containers, sealed and labeled pursuant to MN Statutes 340A.301and Minnesota Rules, part 7515.1100. b.Off-sale of malt liquor shall be limited to the legal hours for off-sale pursuant to Article IV, 76-36 of this Chapter. c.The malt liquor sold must be removed from the licensed premises before applicable off sale closing time pursuant to Article IV, 76-36 of this Chapter. d.The retail sales for a brewer/licensee at an on-sale or off-sale under this paragraph shall not exceed 3,500 barrels per year, provided that off-sale of malt liquor may not total more than 50 percent of the brewers/licensees production or 500 barrels, whichever is less. The malt liquor sold off sale must be produced and packed on the licensed premises in authorized containers, sealed and labeled pursuant to MN Statutes 340A.301and Minnesota Rules, part 7515.1100. b.Off-sale of malt liquor shall be limited to the legal hours for off-sale pursuant to Article IV, 76-36 of this Chapter. c.The malt liquor sold must be removed from the licensed premises before applicable off sale closing time pursuant to Article IV, 76-36 of this Chapter. M. Brewer Taproom License. This license may be issued to the holder of a brewer's license under Minnesota Statutes 340A.301, Subdivision 6, (c ), (i ), or (j ). A brewer taproom license authorizes on-sale of malt liquor produced by the brewer for consumption on the premises of or adjacent to one brewery location owned by the brewer. A brewer may only have one brewer taproom license and may not have ownership in a brewery licensed under Minnesota Statutes 340A.301, Subdivision 6(d). A brewer taproom license may not be issued to a brewer if the brewer seeking the license, or any person having an economic interest seeking the license or exercising control over the brewer seeking the license, is a brewer that brews more than 250,000 barrels of malt liquor annually or a winery that produces more than 250,000 gallons of wine annually. a.The malt liquor sold on sale for consumption must be produced by the brewer on the licensed premises. b.No other beverages containing alcohol may be sold or consumed on the licensed premises. c.Hours of operation for on-sale of malt liquor at a brewer taproom shall be pursuant to Article IV, 76-36 of this Chapter. d.A restaurant is not allowed at a brewery with a taproom license. EFFECTIVE DATE This ordinance takes effect upon its passage and publication in the official newspaper of the City of Isanti. INDEPENDENT SCHOOL DISTRICT NO. 314 ISANTI, PINE, CHISAGO & KANABEC COUNTIES REGULAR SCHOOL BOARD MEETING MAY 20, 2013 7:00PM BAHS COMMUNITY ROOM The regular school board meeting was called to order by Chair Steve Eklund at 7:00 p.m. The Pledge of Allegiance was given. Members present: Steve Eklund, Tony Cuda, Dan Klemz, Zane Braund, Angie Flowers, Robert Hughes, and Supt. Gregory Winter. Members absent: Max Eng. Motion by D. Klemz, second by T. Cuda to adopt the agenda as printed. Carried. Motion by R. Hughes, second by Z. Braund to approve the minutes of the April 15th Regular, the April 24th Emergency, and the April 24th Working school board meetings; approve the May bills, $261,595.77; and accept the May Treasurer's report. Carried. The board reviewed the current enrollment analysis. The school board recognized and thanked BP Fueling Communities for their donation/grant of $6,500 for the basketball program; with a special thank you to Maria Olson, Mille Lacs Oil, who helped facilitate the grant. The basketball program purchased a basketball shooting machine from Shoot-A-Way for the teams. There was nothing addressed under Open Forum. Student Council representative Shaun Hollenkamp reviewed his written report. Student Council members participated in their annual Highway Cleanup Project on Thursday, May 16th. Elementary Principal Jeff Eklund reviewed his written report; which included an update on MCA Testing results, a report on the very successful All-Day, Every-Day Kindergarten Open House, and the 1st - 6th grade Field Trip schedule for May. Assistant Principal Judy Adams reviewed her written report. She reported that teacher interviews, student concerns, special education meetings, and end of the year procedures are keeping her busy. High School Principal Justin Sawyer reviewed his written report, which included a report on the MCA testing and the Post MCA Party; and that Students of Excellence honored at an awards banquet in St. Cloud on April 24th were Cassie Anderson, Sam Anderson, Drew Reilly and Sara Tomlinson. Activities Director Tim Malone reviewed his written report, which included the spring sports playoff dates and that he is working on revisions to the Activity Handbook that will be ready for submission to the school board consideration at the June meeting. Mike Thompson reviewed his OTAS Officer's written report. The district has currently spent 86% of the total 3-year funding to be received from the State for the SIG. Summer School will again be held June 3 - 28, 2013, with the focus being on core subject areas such as Math, Science, Social Studies, and English. The focus of the July - September 2013 plan includes increased learning time opportunities for students. MDE has approved SIG funding for the high school teaching staff to write curriculum this summer. District Assessment Coordinator Joan Proza reviewed her written report. Mrs. Proza reported that the MCA testing schedule has been completed. The board reviewed Community Education Director Cheryl Arnold's written report Sup't Winter's report to the board included updates on recent meetings and conferences. The Isanti County Collaborative has developed a job description and contract for a Chemical Dependency Counselor. The Buildings/Grounds Committee has completed their walk-through to look at possible summer projects. Board members reported on individual meetings and activities attended. Sup't Winter presented the Link Crew Program and Budget Request, followed by discussion. The board would like to see a more comprehensive and more detail oriented school district website. Motion by D. Klemz, second by A. Flowers to approval the Link Crew Program and Budget for the 2013-2014 school year. Carried. Eric Linner, WOLD Architects, presented and reviewed the bid tabulation for the Summer 2013 Re-Roofing Project at Braham Area High School. WOLD Architects recommended awarding the contract to Nieman Roofing, based on the acceptance of the alternate, as follows: Base Bid $133,000.00 Alternate #1 8,500.00 Total Contract $141,500.00 Motion by D. Klemz, second by R. Hughes to award the Summer 2013 Re-Roofing Project at Braham Area High School as recommended by WOLD Architects. Carried. Eric Linner, WOLD Architects, presented and reviewed the bid tabulation for the Summer 2013 Vestibules Projects at the High School and Elementary School. WOLD Architects recommended awarding the contract to RAK Construction as two separate contracts as follows: Elementary $74,345.00 High School $35,874.00 Motion by D. Klemz, second by Z. Braund to award the Summer 2013 Vestibule Project at the High School as recommended by WOLD Architects. Carried. Motion by Z. Braund second by T. Cuda to award the Summer 2013 Vestibule Project at the Elementary School as recommended by WOLD Architects. Carried. Motion D. Klemz, second by T. Cuda to accept, with regret, the letters of retirement submitted by Judy Adams from her Assistant Principal/SIG Administrator position, effective June 30,2013; Nancy Friarson from her Elementary Learning Center Teacher position, effective at the end of the current school year; Pam Theline from her Title I Paraprofessional position, effective May 31,2013; and, with much regret, Vera Goetz from her secretarial position, effective July 1,2013. Carried. The board expressed their deep appreciation for the years of service that Mrs. Goetz has provided to the district. She will be greatly missed. Motion by T. Cuda, second by A. Flowers to accept the letters of resignation submitted by Mike MacDonald from his K-12 vocal Music Teacher position, effective at the end of the current school year; and, Jesse LaValla from his Special Education Teacher position, effective at the end of the current school year. Carried. Motion by R. Hughes, second by A. Flowers to approve the employment of JeanAnn Mattson to fill the 1.0 FTE Elementary Teacher position, effective with the fall 2013 term, BA, Step 2; Jonelle Klemz to fill the 1.0 FTE Social Worker position for the 2013-2014 school year, MA, Step 10; and, Charity Allen to fill the Chemical Dependency Counselor position for the 2013-2014 school year. Carried, with board member D. Klemz abstaining. Motion by D. Klemz, second by T. Cuda to approve the request from Physical Education Teacher Britne Engelking for a child care leave of absence of 45 days for the fall quarter of 2013; August 27th through November 1st Carried. The board held its third reading of Proposed Policy GBB - Family Medical Leave Policy (MSBA410) being presented for consideration of adoption. Motion by D. Klemz, second by T. Cuda to adopt Policy GBB - Family Medical Leave Policy 410. Carried, unanimously. A copy of said policy shall be a part of the official minutes. The board held its second reading and discussion of revised Policy EFF - Meal Charge Policy being presented for consideration of adoption to replace current Policy EFF - Meal Charge Policy. The board held its second reading and discussion of revised Policy JP - Wellness Policy being presented for consideration of adoption to replace current Policy JP - Wellness Policy. Softball Coach Becky Swanson presented and discussed a formal request for the Softball Team to travel to Florida in the spring of 2014. There will be no expense to the school district, the trip is covered by the fundraising efforts of the team members. Motion by D. Klemz, second by R. Hughes to approve the Spring 2014 Softball Trip to Florida. Carried, unanimously. Motion by T. Cuda, second by Z. Braund to renew the district's membership in the Minnesota State High School League for the 2013-2014 school year. Carried. The district must hold this membership in order to be eligible to participate in league-sponsored activities/events. Motion by R. Hughes, second by A. Flowers to authorize Student Assurance Services, Inc., Stillwater, MN to provide district parents an opportunity to purchase insurance coverage for their children for accidents and other purposes for the 2013-2014 school year. Carried. Motion by T. Cuda, second by D. Klemz to set a Working School Board meeting for Tuesday, June 11,7:00 p.m., in the BAHS Community Room. Carried. The purpose of this working meeting will be to continue the district's strategic planning.
