WHEREAS, Minnesota Counties have had to rely increasingly on the property tax to maintain roads and bridges; and WHEREAS, the annual funding gap for counties has resulted in deferring basic maintenance, delaying expansion projects with resulting safety concerns, mounting congestion, and missed economic growth for businesses and commuters; and WHEREAS, the rural road networks in the state should be adequate to bring goods to market; and WHEREAS, transportation-related jobs put over $2.8 billion in the pockets of Minnesotans and generated almost $195 million in income tax revenue in 2011; and WHEREAS, according to the Federal highway Administration (FHWA) every $1 billion invest in highway construction would support approximately 27,800 jobs; and WHEREAS, the overall transportation and transit needs for Minnesota exceed $2.5 billion dollars per year for the next twenty years; and WHEREAS, transportation funding comes primarily from user fees and are constitutionally dedicated to transportation purposes; and WHEREAS, the wheelage fee and local option sales tax for transportation should be options for all county boards to implement to meet their specific county needs; and WHEREAS, a comprehensive transportation solution should include funding for roads, bridges and transit, and address the varying needs in different parts of the state; NOW THEREFORE BE IT RESOLVED that the Isanti County Board of Commissioners encourages the Minnesota Legislature to pass and the Governor to sign a bill that brings adequate funding to Minnesota's Statewide transportation system. ORDINANCE NO. 584 An Ordinance to Amend Cambridge City Code Title lX: General Regulations, Chapter 94 Streets and Sidewalks, The purpose of this amendment is to allow for the Regulation of Sidewalk Café dining. THE CITY OF CAMBRIDGE DOES ORDAIN that Chapter 94: Streets and Sidewalks, General Provisions, is hereby amended as follows: § 94.04 Sidewalk Café's. (A) License required. (1) Any person authorized to operate a restaurant, on designated premises within the City of Cambridge may apply to the City for a license to conduct a portion of the restaurant's authorized business in a sidewalk café on a part of the public way immediately adjoining the designated premises. Application shall be made on forms provided by the City. A restaurant operator, if also licensed under Chapter 114 Alcoholic Beverages of the Cambridge City Code for the on-sale of alcoholic beverages may also request an amendment to the license to allow this sidewalk cafe to be a part of the licensed premises. (2) A scaled diagram will be required to be submitted with information as requested on the application, including but not limited to, the dimensions of the sidewalk café area, existing fixtures or other obstacles, dimension from sidewalk café to curb, position of tables, chairs, plant boxes, and anything else to be placed on the sidewalk, and the width of the sidewalk remaining for pedestrian use (40 inches or more required). In the case of establishments holding beer, wine or liquor licenses and wishing to serve alcohol in the sidewalk café, this diagram shall be considered a description of the extended premises for purposes of the request to amend the beer, wine or liquor license. (B) Restrictions. (1) Each sidewalk café license shall specify the area in which the café may be operated. No café sale or service shall be permitted in any portion of the street designated for vehicular travel. (2) No license shall authorize any permanent installation on the public way, or permit the placing or leaving on the sidewalk of any tables, chairs, furnishings or other equipment during any periods of time such sidewalk café is not open and being operated. (3) Sidewalk café accessories (tables, chairs, and any other obstacles) must be removed from the sidewalk at 10:00 p.m. each day and must not be established before 10:00 a.m. each day. The sidewalk café must maintain a minimum of 40 inches clearance from all obstacles for pedestrians. (4) Sidewalk café's may only be open April 1 through October 15 of any year to provide for snow removal. (5) Trash and debris shall be removed from the sidewalk café area each day, as well as any stains on the sidewalk or street. (6) No signage or advertising is permitted in the sidewalk café area. (7) No license shall authorize a sidewalk café at any location prohibited by state law, or this section, except as herein provided. (8) Except as specifically provided herein, the ownership, operation and maintenance of a sidewalk café shall be subject to all applicable laws, ordinances and regulations. C. Indemnification and Insurance. Before a license is issued pursuant to this section, the applicant shall: (1) Execute and deliver to the City Clerk, on a form prescribed by the City, an agreement in which the applicant agrees to indemnify, defend and hold the City harmless from any personal injury or property damage resulting from, or in any way related to, operation of the sidewalk café. (2) File with the City Clerk, evidence of insurance protecting the applicant against liability imposed by law arising out of the ownership, maintenance or operation of such sidewalk café with limits in amounts consistent with the municipal tort liability limits set forth in Minn. Stat. Chapter 466, as amended from time to time. The City shall be named as an additional named insured in the policy providing the insurance. The policy shall further provide that it may not be canceled except upon 10 days' written notice filed with the City Clerk. No license issued pursuant to this section shall be valid at any time the insurance required herein is not maintained and evidence of its continuance filed with the City Clerk. (D) Suspension and Revocation. (1) Any license authorized by this section may be revoked at any time by the City. The license may also be suspended by the City for a period as the City shall determine. (2) Upon conviction of the licensee, or the licensee's agent, or employee for the violation of any City ordinance or state law in connection with the ownership, maintenance, or operation of a sidewalk café, the license shall automatically become suspended. The suspension shall continue until the Council has acted. E. Separability. Every provision of this section shall be separable from every other provision, to the extent that if any provision shall be held invalid by a court of competent jurisdiction, it shall not invalidate any other provision. All other sections and subsections of this Chapter shall remain as written and previously adopted by the City Council. This ordinance shall become effective upon publication. ORDINANCE NO. 585 An Ordinance to Amend Cambridge City Code Title III: Administration, Chapter 38 Administrative Citations for Enforcement of the City Code, The purpose of this amendment is to eliminate the hearing process for individuals who request an extension for a code enforcement violation. THE CITY OF CAMBRIDGE DOES ORDAIN that Sections 38.04 and 38.05: Administrative Citation and Administrative Hearing are hereby amended as follows: § 38.04 ADMINISTRATIVE CITATION. (A)A person authorized to enforce provisions of the city code may issue an administrative citation upon belief that a code violation has occurred, after first sending a property maintenance concerns letter sent to the property owner notifying them of the violations. The citation must be issued in person or by U.S. first class mail to the person responsible for the violation or to the property owner identified by the Isanti County property records. (B)The person responsible for the violation must either pay the scheduled civil penalty and come into compliance or request a hearing within 10 days after issuance. Payment of the civil penalty constitutes admission of the violation. A late payment fee of 10 percent of the scheduled civil penalty amount may be imposed. The fines will be rescinded if compliance is achieved by the compliance date. (C)Requesting a Hearing. The request must be in writing and executed by the property owner or person with an ownership interest in the property. It must minimally state the name and mailing address of that person, that person's relationship to the property involved, and a brief statement why the citation is in error and a hearing is being requested. (A)A property owner may request an extension to come into compliance, which may be granted or denied by the City. If an extension to come into compliance is requested and granted, and the property owner does not come into compliance by the extension date, the administrative fine imposed with the citation for the violation shall not be rescinded. Additionally, a request for an extension to the compliance deadline shall constitute an admission to the violation, and a waiver of a right to request a hearing under subparts (B) and (C) above. § 38.05 ADMINISTRATIVE HEARING. Any person contesting an administrative offense pursuant to this chapter may, with 10 days after the issuance of the notice of the violation, request a hearing, except for those persons who requested an extension as indicated in 38.04 (D). A hearing officer shall conduct an informal hearing to determine if a violation has occurred. The hearing officer shall have authority to dismiss the violation or reduce or waive the penalty. If the violation is sustained by the hearing officer, the violator shall pay the penalty imposed within ten days of the date of the decision and come into compliance by the specified date given at the hearing. All other sections and subsections of this Chapter shall remain as written and previously adopted by the City Council. This ordinance shall become effective upon publication. ORDINANCE NO. 551 AN ORDINANCE TO AMEND THE CODE FOR THE CITY OF ISANTI, CHAPTER 325, WATER THE CITY COUNCIL OF THE CITY OF ISANTI DOES ORDAIN: Section 325-9, Right to discontinue service reserved, Article II, of Chapter 325 of the Code of the City of Isanti is hereby amended to add the following text: § 325-9. Right to discontinue service reserved. A. Notice. The City of Isanti shall notify any customer who has a sewer/water account 30 days past due. The notification shall include: (1) The amount owed the City including interest and other appropriate charges. (2) Date by which the account must be paid. (3) Service Shutoff date. (4) If the customer does not contact the City by the date by which the account must be paid, the City shall hand deliver a shutoff notice to the delinquent party's premises. A delinquent posting notice fee as set by resolution of the City Council and specified in City Code Chapter A344, Fee Schedule, shall be charged to the delinquent party's account to cover administrative costs associated with the preparation and delivery of this notice. B. Shutoff. Services will be discontinued to the accounts who have not made arrangement with the City regarding the payment of delinquent account. C. Charges. The City shall charge a fee to discontinue services and a fee to reinstate services to a delinquent account. Fees shall be as set by resolution of the City Council as specified in City Code Chapter A344, Fee Schedule. D. User/Owner shutoff request. The owner or their authorized agent may request that their water be shutoff. The City will then shut off the water and if necessary remove the water meter for a fee. Turning on the water and reinstalling the meter will cost an additional fee. Fees shall be as set by resolution of the City Council, as specified in City Code Chapter A344, Fee Schedule. While the water is shutoff, the owner/user will not be billed for the monthly water base fee charge. E. Shutoff due to utility disconnection and vacancy. If the account has the electric and/or gas utilities services shut off during the time period between October 15 and April 15, and the City determines in good faith that the premises has been vacated by the former account holder and no transfer of the account has been made, the City reserves the right to discontinue water service to the premises. The account shall be deemed delinquent and charges to reinstate the account as per Subsection C of this section shall apply. [Added 9-16-2008 by Ord. No. 443] F. Refusal to allow access. If any owner refuses to give consent to enter the premises served to inspect a meter and/or obtain a meter reading the City will pursue an administrative search warrant to gain access. [Added 12-16-2008 by Ord. No. 447] G. Shutoff by City only. No person, party or firm shall turn on or off the water supply at the curb stop without permission of the City. In emergency situations, water may be shut off or turned on, with the City notified as soon as practical. H. Shutoffs in Multi Unit Buildings. In a situation where the water supply has been shutoff to one or more units in a multi unit building, water will not be turned on and/or a meter reinstalled if the customer/owner has delinquent accounts in other units in the same building.
