NOTICE OF AMENDMENT TO THE ISANTI COUNTY ZONING ORDINANCE
The Isanti County Board of Commissioners adopted the following amendment to the Isanti County Zoning Ordinance on September 6, 2017. This amendment will amend the Isanti County Zoning Ordinance Section 14, General Regulations, Subdivision 13.
The Ordinance as amended will read as follows:
Section 14, General Regulations, Subdivision 13
For land that is divided, split, or subdivided, a lot shall not use or take a building right within the quarter-quarter section where the lot is located when (1) that lot is owned in fee title by the united States of America, the State of Minnesota, the County of Isanti, or any City or Township located in Isanti County; and (2) that lot is used for an existing or planned road or for an existing or planned public utility. For land that is divided, split, or subdivided, it shall not use or take a building right with the quarter-quarter section where that lot is located when (1) the lot is owned in fee title; (2) the lot is used for railroad purposes; and (3) the lot contains no buildings. Parcel which are owned and used as set forth above shall not constitute a division, split, or subdivision of a quarter-quarter section or government lot which otherwise consists of one parcel of land. (For example: for a 40-acre quarter-quarter section containing 3 acres of road, the remaining 37 acres would be considered a full quarter-quarter that has not been divided or split, and that is entitled to be split or divided once without platting). Parcel which are owned and used as set forth above do not result in the loss of a building right in the quarter-quarter section or government lot that is affected and the development rights shall be determined by dividing the total acreage in the quarter-quarter section by 4 and then dividing the property size by that factor. (For Example: for a 40 acre quarter-quarter section containing two acres of road, there would be 38 acres remaining in that quarter-quarter section; dividing those 38 acres by 4 would equal 9.5 acres per building right. A 19-acre parcel within that quarter-quarter section would therefore be divided by 9.5 acres to determine its building rights, and it would contain two building rights).
