THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTIFICATION OF THE ORIGINAL CREDITOR WITHIN THE TIME PERIOD PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.
NOTICE IS HEREBY GIVEN: That default has occurred in the conditions of the mortgage dated February 23, 2007, MIN 100488910122330680, executed by Gary Hempel, a single person and Roberta V. Buck, a single person, as mortgagors, to Mortgage Electronic Registration Systems, Inc., as mortgagee and nominee for New Century Mortgage Corporation, recorded in the office of the County Recorder of Isanti County, Minnesota, on March 7, 2007, as Document No. 376341, which mortgage was assigned to Vanderbilt Mortgage and Finance, Inc. by Assignment of Mortgage dated April 25, 2012 and recorded in the office of the Isanti County Recorder on May 9, 2012, as Document No. 424934, which mortgage conveyed and mortgaged the following described property, situated in the County of Isanti and State of Minnesota, which property has a street address of 4868 305th Lane Northwest, Cambridge, Minnesota 55008, and tax identification number 09-013-2100:
That part of the Southeast Quarter of the Northeast Quarter of Section 13, Township 35, Range 25, described by metes and bounds as follows, to wit: Commencing at a point on the South line of County aid road 40 at its intersection with the East line of said Section 13, thence West and on the South line of County aid road 40 a distance of 37 rods and 3.00 feet, thence South and parallel with the East line of said Section 13, 19 rods, thence East and parallel with the South line of County aid road 40 a distance of 37 rods and 3.00 feet to the East line of Section 13, thence North on the East line of Section 13, 19 rods to the place of beginning.
And
That part of the Southeast Quarter of the Northeast Quarter of Section 13, Township 35, Range 25, Isanti County, Minnesota, described as follows: Commencing at the Southeast corner of the Southeast Quarter of Northeast Quarter of Section 13; thence North 00 degrees 42 minutes 10 seconds East, assumed bearing, along the East line of said Southeast Quarter of Northeast Quarter, a distance of 225.76 feet to the point of beginning of the parcel to be herein described; thence South 89 degrees 39 minutes 00 seconds West, a distance of 613.50 feet; thence North 00 degrees 42 minutes 10 seconds East, a distance of 346.50 feet to the center line of 305th Lane Northwest (also known as County road number 40); thence Easterly, along said center line, a distance of 613.50 feet to the East line of said Southeast Quarter of Northeast Quarter; thence South 00 degrees 42 minutes 10 seconds West, along said East line, a distance of 346.50 feet to the point of beginning. Subject to the existing 305th Lane Northwest (also known as County Road Number 40) along the North line thereof and subject to the existing Roanoke Street Northwest along the East line.

That part of the Southeast Quarter of the Northeast Quarter of Section 13, Township 35, Range 25, Isanti County, Minnesota, described as follows: Beginning at the Southeast corner of the Southeast Quarter of Northeast Quarter of Section 13; thence North 00 degrees 42 minutes 10 seconds East, assumed bearing, along the East line of said Southeast Quarter of Northeast Quarter, a distance of 225.76 feet; thence South 89 degrees 39 minutes 00 seconds West, a distance of 613.50 feet; thence North 00 degrees 42 minutes 10 seconds East, a distance of 346.50 feet to the center line of 305th Lane Northwest (also known as County road number 40); thence Westerly, along said center line, a distance of 721.30 feet to the West line of said Southeast Quarter of Northeast Quarter; thence South 00 degrees 47 minutes 20 seconds West, along said West line a distance of 540.60 feet to the Southwest corner of said Southeast Quarter of Northeast Quarter; thence South 89 degrees 10 minutes 20 seconds East, along the South line of said Southeast Quarter of Northeast Quarter, a distance of 1335.27 feet to the point of beginning. Subject to the existing 305th Lane Northwest (also known as County Road Number 40) along the most Northerly line thereof and subject to the existing Roanoke Street Northwest along the most Easterly line thereof, Isanti County, Minnesota.
That the original principal amount secured by said mortgage was $222,400.00; that there has been compliance with any condition precedent to acceleration of the debt secured by said mortgage and foreclosure of said mortgage required by said mortgage, any note secured thereby, or any statute; that no action or proceeding has been instituted at law to recover the debt remaining secured by said mortgage, or any part thereof; that there is claimed to be due upon said mortgage and is due thereon at the date of this notice, the sum of $258,480.78 in principal and interest.
That by virtue of the power of sale contained in said mortgage, the said mortgage will be foreclosed by the sale of the above described premises with appurtenances, which said sale will be made by the Sheriff of Isanti County, Minnesota, at the Sheriffs main office in the Law Enforcement Center, 509 18th Avenue Southwest, Cambridge, Minnesota, on August 21, 2014, at 10:00 oclock a.m., at public auction to the highest bidder, to pay the amount then due on said mortgage, together with the costs of foreclosure, including attorneys fees as allowed by law, in accordance with the provisions of said mortgage. The time allowed by law for redemption by the mortgagors, their personal representatives or assigns, is six (6) months from the date of said sale.
MORTGAGOR(S) RELEASED FROM FINANCIAL OBLIGATION ON MORTGAGE: NONE
THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGORS PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
If the mortgage is not reinstated under Minn. Stat. 580.30 or redeemed under Minn. Stat. 580.23, the mortgagor must vacate the mortgaged property by 11:59 p.m. on February 23, 2015, unless the foreclosure is postponed pursuant to Minn. Stat. 580.07, or the redemption period is reduced to five (5) weeks under Minn. Stat. 582.032. .
