AN ORDINANCE AMENDING
ORDINANCE NO 445 ZONING;
SECTION 6 RESIDENTIAL
DISTRICTS; SECTION 13
USE REGULATIONS, ARTICLE

STRUCTURES, AND USES;
SECTION 15 FENCING,
SCREENING, AND
LANDSCAPING; AND SECTION
17 OFF-STREET PARKING AND
LOADING TO REQUIRE
ZONING PERMITS
THE CITY OF ISANTI DOES ORDAIN:
I. AMENDMENTS
Section 6: Residential Districts, Article 1 R-1 Single-Family Residential District, Subdivision 6 Lot Requirements and Setbacks is hereby amended to include and read as follows:
E. Driveway Requirements.
All driveways shall be surfaced with concrete or bituminous. Porous pavement may be considered. Driveways shall be installed within one (1) year of building permit issuance, if due to climate weather situations this is not feasible; an escrow amount is required by the City to defer installation.
Maximum Driveway Width at R-O-W 30 feet
On cul-de-sacs 50% of the lot frontage or 30 feet, whichever is less
Driveway and Parking Area Setback Five (5) feet from the side lot line in absence of a drainage and utility easement
E. F. Usable Lot Requirements.
II. AMENDMENTS
Section 6: Residential Districts, Article 2 R-2 Single-Family Residential District, Subdivision 6 Lot Requirements and Setbacks is hereby amended to include and read as follows:

VI. AMENDMENTS
Section 13: Use Regulations, Article 4 Accessory Buildings, Structures, and Uses; Subdivision 1 Residential Districts is hereby amended to include and read as follows:
D. Zoning Permits Required.
Unless a building permit is required, prior to construction and installation of any of the following, a zoning permit is required:
1. Accessory structure at 120 square feet or less in floor area.
2. Residential patios and decks not attached to a structure, which is less than thirty (30) inches in height above grade.
VII. AMENDMENTS
Section 15: Fencing, Screening, and Landscaping, Subdivision 1 General Provisions is hereby amended to include and read as follows:
Subdivision 1: General Provisions.
Except as otherwise provided herein, all fences and walls within the City shall be subject to the following general provisions:
A. Building Permit Required.
A. Building Permit. Prior to the construction and/or installation of a fence, an application for a building permit shall be obtained from the City and shall specify the intended location, character, and size of such fence or wall.
B. Zoning Permit. For all other fences, not meeting the requirements for a building permit, a zoning permit must be obtained prior to construction on the property.
VIII. AMENDMENTS
Section 17: Off-Street Parking and Loading is hereby amended to include and read as follows:
Subdivision15: Residential Parking Requirements
A. Permit Requirements.
Unless having been issued a building permit for new residential home construction, all new driveway construction, re-construction or alteration, driveway extensions or parking area construction for vehicles and equipment stored outside must file and receive zoning permit approval by the Zoning Administrator or their designee.
B. Driveway Requirements.
1. All driveways shall be surfaced with concrete, bituminous, asphalt, or driveway paver systems with a minimum thickness of 60 mm 2 3/8 inch with gaps not to exceed 1/4 of an inch.
2. Driveways shall be installed within one (1) year of building permit issuance, if due to climate weather conditions this is not feasible; an escrow amount is required to differ installation.
3 Maximum driveway width at the ROW 30 feet
On cul-de-sacs 50% of the lot frontage or 30 feet, whichever is less
Driveway and Parking Area Setback Five (5) feet from the side lot line in the absence of a drainage and utility easement
Subdivision 16: Section 15: Exemptions
Properties located within the D-1 Downtown Overlay District are subject to the parking requirements as provided for within Section 11 of this Ordinance, unless otherwise specified.
IX. EFFECTIVE DATE
This ordinance shall take effect upon its adoption and publication in the Citys Official Newspaper.
