NOTICE OF MORTGAGE FORECLOSURE SALE
Date: September 12, 2013
YOU ARE NOTIFIED THAT:
1. Default has occurred in the conditions of that certain Mortgage dated July 7, 2008 executed by Gregory C. Sjodin, a single person, as borrower, to Frandsen Bank & Trust, a Minnesota chartered banking corporation, as lender, filed for record December 2, 2008 as Document Number 394864 in the Office of the County Recorder of Isanti County, Minnesota. The land described in the Mortgage is not registered land.
2. The Mortgage has not been assigned.
3. The original principal amount secured by the Mortgage was $160,000.00.
4. No action or proceeding at law is now pending to recover the debt secured by the Mortgage, or any part thereof.
5. The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage, and all notice and other requirements of applicable statutes.
6. At the date of this notice the amount due on the Mortgage, and taxes, paid by the holder of the Mortgage is $152,193.73.
7. Pursuant to the power of sale in the Mortgage, the Mortgage will be foreclosed, and the land described as follows:
That part of the Southwest Quarter of the Southwest Quarter, Section 22, Township 36, Range 23, Isanti County, Minnesota, described as follows:
Beginning at the southwest corner of said Southwest Quarter of the Southwest Quarter; thence easterly, on an assumed bearing of North 89 degrees 59 minutes 30 seconds East, a distance of 786.24 feet; thence North 00 degrees 49 minutes 41 seconds West a distance of 1309 feet, more or less, to the north line of said Southwest Quarter of the Southwest Quarter; thence westerly along said north line to the west line of said Southwest Quarter of the Southwest Quarter; thence southerly along said west line to the point of beginning. Contains 23.2 acres, more or less.
TOGETHER WITH all the improvements now or hereafter erected on the property, and all easements, appurtenances and fixtures now or hereafter a part of the property, will be sold by the Sheriff of Isanti County, Minnesota, at public auction on Wednesday, November 6, 2013 at 10:00 a.m., at the Isanti County Sheriffs Office, 509 18th Avenue SW, Cambridge, Minnesota 55008.
8. The time allowed by law for redemption by Mortgagor or Mortgagors personal representatives or assigns is twelve (12) months after the date of sale.
9. THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGORS PERSONAL REPRESENTATIVES OR ASSIGNS MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
10. THIS COMMUNICATION IS FROM A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
11. RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION.
