Sexual assault on juvenile yields 45 days jail, probation

on 15 years probation and ordered to spend 45 days in jail.

A 22-year-old Hamburg, Minn., man who admitted having a sexual relationship with a 13-year-old girl in Isanti County has been placed on 15 years probation and ordered to spend 45 days in jail.

Brent Allan Alling was charged April 1, 2010 with felony 3rd degree criminal sexual conduct-victim 13-15 years old and actor 24 months older, following an investigation that revealed he had been staying at the victim’s residence periodically with the knowledge of her mother and sleeping in the victim’s bed.

Because the victim was less than 16 years old and Alling is more than 24 months older, the charge is deemed a serious penalty and could be punishable by up to 15 years in prison under state sentencing guidelines.

Under stipulations in the probation agreement, Alling is to pay a $135 fine, $600 restitution to the victim, serve 45 days in jail, and is prevented from contact with persons under 18 years of age.

He is not to possess any pornographic or explicit material, is to attend a psychosexual education program and his cellphone and computer will be subject to a search for any pornographic material or contact with minors.

According to the original criminal complaint lodged against him in 10th District Court, Alling admitted not only to the sexual relationship with the girl but that he had sent her photos of himself and requested a nude photo of her.
